Love Letters: Official Terms and Conditions

  • Eligibility:
    • 18Karat’s Love Letters Contest  is open only to residence of Ontario, Canada who are 18 years old at the time of entry.
    • Contest is subject to all applicable Federal, Provincial, and Municipal laws and regulations. Void where prohibited.
    • Participation constitutes entrant's full and unconditional agreement to these Official Rules and Sponsor and Administrator's decisions, which are final and binding in all matters related to the Giveaway.
  • Sponsor:
    • 18Karat, 275 Dundas Street West, Toronto, Canada, M5T 1G1
  • Contest Timeline:
    • Contest begins January 16th 2012 at 12:00pm EST and ends February 11th  2012 at 12:00am EST.
  • How to Enter:
    • Participants must submit contact information and original written love letters via the Love Letters Contest page: http://18karat.ca/loveletters.html
    • Participants who do not submit complete or accurate contact information will be disqualified.
    • No purchase necessary.
    • Only one entry, per participant.
  • Drawing:
    • An Administrator whose decision as to the administration and operation of the Giveaway and the selection of the potential winner is final and binding in all matters related to the Giveaway.
    • Administrator will select the winning entries based on the original content of the love letters received.
    • The potential winner will be notified via email and telephone and will be required to sign and return to Sponsor, within (10) days of the date notice or attempted notice, an affidavit of eligibility, liability, and publicity release in order to claim the prize.
    • If a potential winner cannot be contacted, or fails to sign and return the affidavit of eligibility, liability and publicity release within the required time period, the potential winner forfeits prize.
    • Potential winner must continue to comply with all terms and conditions laid out herein – winning is contingent upon fulfilling all requirements.
    • In the event that a potential winner is disqualified for any reason, Sponsor will award the prize or prizes to an alternate winner.
  • Prize:
    • One first place prize: a loose brilliant cut Canadian diamond of approximately 0.20ct. (retail value of $600)
    • The winner is responsible for picking up their prize from 18Karat on date organized by both winner and sponsor.
    • Prize is non-transferable and no substitution will be made.
    • Sponsor reserves the right to substitute a prize for one of equal or greater value if the designated prize should become unavailable for any reason.
    • Winner is responsible for all taxes and fees associated with prize receipt and/or use.
    • Odds of winning depend on the number of eligible entries.
  • Release:
    • By the receipt of prize, winner agrees to release and hold harmless Sponsor, Administrator, and their respective subsidiaries, affiliates, suppliers, distributors, and prize supplier from and against any claim and cause of action, including, but not limited to, personal injury, death, or damage to or loss of property, arising out of participation in the Giveaway or receipt or use or misuse of prize.
  • Publicity:
    • Except where prohibited, participation in the Giveaway constitutes winner’s consent to Sponsor’s and its agents’ use of winner’s name, likeness, photograph, voice, opinions and/or hometown for promotional purposes in any media, worldwide, without further payment or consideration.
  • General Conditions:
    • Sponsor reserves the right to cancel, suspend, and/or modify the Giveaway, or any part of it, if any fraud, technical failures or any other factor beyond the Sponsor’s reasonable control that impairs the integrity or proper functioning of the Giveaway, as determined by Sponsor in its sole discretion.
    • Sponsor reserves the right in its sole discretion to disqualify any individual it finds to be tampering with the entry process or the operation of the Giveaway or to be acting in violation of these Terms and Conditions or any other Promotion or in an unsportsmanlike or disruptive manner.
    • Any attempt by any person to deliberately undermine the legitimate operation of the Giveaway may be a violation of criminal and civil law, and, should such an attempt be made, Sponsor reserves the right to seek damages from any such person to the fullest extent permitted by law.
    • Sponsor’s failure to enforce any term of these Terms and Conditions shall not constitute a waiver of that provision.
  • Limitation of Liabilities:
    • The Released Parties are not responsible for:
      • Any incorrect or inaccurate information, whether caused by entrants, printing errors or by any of the equipment or programming associated with or utilized in the Giveaway;
      • Technical failures of any kind, including, but not limited to malfunctions, interruptions, or disconnections in phone lines or network hardware or software;
      • Unauthorized human intervention in any part of the entry process of the Giveaway;
      • Technical or human error that may occur in the administration of the Giveaway or the processing of entries.
      • Any injury or damage to persons or property which may be caused, directly or indirectly, in whole or in part, from entrant’s participation in the Giveaway or receipt or use of any prize.
    • No more than the stated prize will be awarded.

In the event that production, technical, seeding, programming or any other reasons cause more than stated number of prizes as set forth in these Terms and Conditions to be available and/or claimed Sponsor reserves the right to award only the stated number of prizes selected from all legitimate, un-awarded, eligible prize claims.
